Know what an eviction is called and how it starts. In Oklahoma, the eviction lawsuit is a Forcible Entry and Detainer, or FED, action. For nonpayment of rent, the landlord must first give written notice giving you 5 days to pay the rent or move out before filing. To end a month-to-month tenancy without cause, the landlord must give at least 30 days.
After the notice period, the case moves fast: the landlord files, you get a summons with a hearing date, and FED cases are decided quickly. Going to that hearing is essential.
The end of the process is fast too. If the judge rules for the landlord, you may have as little as 48 hours to move. If you do not, the landlord can get a writ of execution and law enforcement posts a final 48-hour notice before removal. A landlord cannot lawfully lock you out or remove your belongings without going through this court process.
There is a money protection worth knowing: on security deposits, the landlord has 45 days after you move out to return the deposit or give written reasons for withholding it.
